CONSTITUTIONAL COURT HOLDS REGULAR PLENARY SESSION
At the session, on the basis of the complaint of citizen Hajiaga Aliasker oglu Nuri, was considered the constitutional case concerning check of conformity of the decision of Judicial Board on civil cases of the Supreme Court of the Azerbaijan Republic from September 26, 2005, to the Constitution and laws of the Azerbaijan Republic.
Having heard the report of judge S. Salmanova on the case, the statements of the applicant and representatives, having studied and discussed the materials of the case, Plenum of the Constitutional court has adopted the decision.
In the decision, it is stated that due to discrepancy of the decision from September 26, 2005, to the decision of the Central Election Commission of the Azerbaijan Republic # 28/132 from September 14, 2005, concerning cancellation of the decision of Sabunchi district election commission, the third constituency # 28 on registration of Hajiaga Aliasker oglu Nuri, as the candidate for elections by the Article 56.1 and 60.1 of the Constitution of the Azerbaijan Republic, to Articles 416 and 418.1 of the Civil-Procedural Code of the Azerbaijan Republic to count invalid. According to the present decision, the case is to reconsider in the order and term, established by the Civil-Procedural legislation of the Azerbaijan Republic.
The decision inures from the date of the promulgation, is final and cannot be cancelled, changed or officially interpreted by any body or person.
