LAND CODE TO BE AMENDED
As correspondent of AzerTAj informs, discussed was the question on amendment in the Land Code of the Azerbaijan Republic.
Chairman of the Committee Eldar Ibrahimov has noted that the President of Azerbaijan has directed according to the legislation initiative to parliament a bill on amendments in the Articles 73 and 84 of the Land Code.
In the amendment offered for entering into the Article 73, establishing bases of the termination of the rights of legal and physical persons above the land areas, necessity of withdrawal of the land areas for state is stated that municipal and social needs is established by the legislation. In the previous variant it was specified the decision of the given question directly by judicial way. In opinion of experts and deputies, the court should be last instance only at the solution of the disputable questions, and offered change is completely expedient.
In the amendment offered for entering into the Article 84, connected to protection of the rights of proprietors, users and tenants of the land, it is said: “Conditions of withdrawal of the land areas under the property of legal or physical persons and have been handed by them in rent, for state, municipal and social needs, are adjusted by the Civil Code of the Azerbaijan Republic ”.
Deputies have approved also this offer and have made decision on submission of the project for discussion of the Milli Majlis.
