PRESIDENT SUBMITS DRAFT LAW “ON CONSTITUTIONAL COURT” TO PARLIAMENT
Chief of Presidential Administration Department on Working with Law Enforcement Bodies Fuad Alasgarov told AzerTaj that the draft law submitted to the Parliament by Mr. Ilham Aliyev contains more effective mechanisms for human rights protection. According to the draft, every person has given the right to apply to the Constitutional Court if he had failed to obtain appropriate local court’s decision, and exhausted all his possibilities. The Constitutional Court is also allowed to consider a citizen’s application in case if the Supreme Court’s decision contradicts the Constitution. The draft also envisages introducing alterations in the Constitutional Court’s structure e.g. establishing of Chambers and Plenum within the Constitutional Court. The Chambers will consider merely the issues of acceptance of complaints submitted to the Constitutional Court, while the Plenum will give judgment on the issue.
