NEW DRAFT LAW ON FREEDOM OF INFORMATION WORKED OUT
Parliament is expected to pass a new law on freedom of information. Member of the Milli Majlis Standing Commission on Security and Defense Affairs and the working group on this project Rizvan Jabiyev told AzerTaj the previous law is of declarative character and does not have effective mechanism. That’s why, according to him, the new draft law has been worked out upon Council of Europe’s recommendation and at the initiative of the Presidential Administration. In accordance with the Law “On Consideration of the Applications and Complaints of Citizens”, the information is envisioned to be provided within one month; in case it loses its efficiency - within 24 days, and if it is needed for people’s security and health - within 48 hours.
One of the novelties is an establishment of the institute of commissioner as a guarantor of the right to have information. The project foresees to give him serious authorities: along with conducting investigation, he will be given the right to make decisions to have a legal effect.
A sphere of restriction of information is also indicated in the project.
