INTERNATIONAL SEMINAR ON THE “METHODS OF STUDYING INDIVIDUAL COMPLAINTS” HELD IN BAKU
Opening the seminar, chairman of the Constitutional Court of the Azerbaijan Republic Farhad Abdullaev welcomed participants and visitors and has presented director of the Center of documenting of the Constitutional Court of Slovenia Arne Mavchich, the Secretary General of the Constitutional Court of Germany Louise Barnshtedt, the vice-president of the Constitutional Court of Latvian Republic Dzintir Pedzeden, the judge of the Constitutional Court of Slovakia Ian Kluchkan, the secretary of Arbitration Court of Belgium Rick Rickboer, chief adviser of the Constitutional Court of the Russian Federation Bakhtiyar Tuzmohammadov and the coordinator of the Venice Commission, Carolyn Marten. It has been marked that representatives of OSCE, the American Association of Lawyers also are invited to the educational seminar and the Technical Cooperation Society of Germany.
Having emphasized that after death of the national leader of Azerbaijan people Heydar Aliyev, such international seminar is carried out in Baku for the first time, Farhad Abdullaev has told that today our people marks 12th anniversary of Khojali tragedy. 12 years ago the Armenian aggressors have made mass punishment above the inhabitants of Khojali.
The memory of victims of the tragedy was revered by minute of silence.
The coordinator of the Venice Commission Carolyn Marten has told in a statement on the purposes of the educational seminar, noting that successful communication between the Organization that she represents and Azerbaijan are at high level. Having emphasized, that the basic question is connected with conclusion of studying of individual complaints in practice of work of the Constitutional Court, the guest told that it is one of the obligations accepted by Azerbaijan it took before the Council of Europe. The work done in Azerbaijan for last two years deserves high estimation. In recently accepted Law “On the Constitutional Court”, a special place that fully complies with the obligation is given to a question of studying of individual references.
Ms. Carolyn Marten, having noted that “studying of individual references in the Constitutional Court is the important question and one of constitutional laws of citizens”, said that this question became a problem in the various European countries, also has reminded of experience of many states in the given sphere. She told that she is ready to assist expansion of experience of the Azerbaijani colleagues. It is important that each court possessed highly professional competent staff. In process of growth of quantity of the complaints the increasing value gets their effective consideration, and it is necessary to observe procedural rules. We are ready to share experience and in these areas. I think that participants will take for themselves the certain advantage from the present seminar.
Chairman of Constitutional Court of Azerbaijan Republic, Farhad Abdullaev, acting with the report on the topic “Work with individual complaints”, said: “We are cooperating with the Venice Commission of the Council of Europe due to what for today together with this organization a number of seminars and conferences has been carried out. These actions had great value from the point of view of realization by the Constitutional Court of the activity. Such it is possible to count and today's action.
F. Abdullaev dwelt on the positions of recently accepted law on the Constitutional Court, in particular, on the questions connected to the reference of citizens in the Constitutional Court, and has emphasized: “Participation in a present educational seminar of experts, lawyers of the countries having sufficient experience, will have extremely great value and becomes useful to our employees”.
In detail informing about the creation, the organization of body supervised by him, its internal structures and their work, F. Abdullaev informed, that as a result of the changes brought in the Constitution of the Azerbaijan Republic, the National Referendum carried out on August 24, 2002, in the Constitutional Court the institute of the individual complaint has been created. According to the said changes, opinions of experts of the Venice Commission have been taken into account in connection with the accepted new law “ On the Constitutional Court”, found the reflection in the law. Thus, creation of institute of the individual complaint and acceptance of the new law promoted modification in structure of the Constitutional Court.
The lecturer has noted that the forthcoming primary goal consists of discussion of the practical questions generated from the conducted reforms, and carrying out exchange by opinions, especially having emphasized, that the present seminar was joined by judges of the Constitutional Court, employees of its departments and representatives of mass media.
After a break, the first session of the seminar has continued the work under presidency of the judge of the Constitutional Court of Azerbaijan Aladddin Sultanov. The secretary general of the Constitutional Court of Germany, Ms. Louise Barnshtedt delivered a lecture on the topic «Experience of the Constitutional Court of Germany», the chief adviser of the Constitutional Court of Russia Bakhtiyar Tuzmohammadov on the topic “Methods of consideration of complaints in the Constitutional Court of the Russian Federation”.
Large discussions connected to the organization of the Constitutional Court of the Azerbaijan Republic, methods and experience of consideration of individual complaints in courts of some of the European states have taken place.
The seminar will continue its work on February 27.
