CEC HOLDS REGULAR SESSION
As informed from the press service of the Central Election Commission, chairman of the Commission has submitted for discussion the question on representation in the Constitutional Court of the Azerbaijan Republic of reports of the district election commissions with the documents enclosed to them for drawing up by the Central Election Commission of the report on the general results of elections, check and the statement of results of elections in connection with the elections carried out on November 6, 2005 to Milli Majlis the Azerbaijan Republic of the third convocation. Chairman of the Central Election Commission told: “According to the requirement of Article 171.2 of the Election Code of the Azerbaijan Republic, the Central Election Commission follows not later than after 20 days from the date of voting to check up reports of the district election commissions together with the documents enclosed to them and within 48 hours to present them to the Constitutional Court. From the date of voting, during the term established by the law in the Central Election Commission, were received 538 references, the given references have been considered according to requirements authorized by the Election Code of the Central Election Commission on the basis of recommendations of the Venice Commission of the Council of Europe “Instructions on rules of consideration of the references received by the election commission about infringement of suffrages”. As a whole, results of elections on 460 polling districts have been recognized void. The Central Election Commission has recognized void the elections on 4 constituencies. Recognition void of the results on some polling districts in 2 constituencies were reflected in results of elections on the given constituencies, the persons recognized as winners were replaced. Now, consideration of all references submitted in the Central Election Commission and check of reports of the district election commissions has ended, today the abovementioned documents will be presented to the Constitutional Court.
Speaking then the overwhelming majority of members of the Central Election Commission have noted, that elections to Milli Majlis have been carried out according to requirements of the law, that, except for some errors, results of elections, as a whole, it is possible to count satisfactory. Members of the Commission ascertained that this idea has been underlined also by many authoritative international observers.
Sharing opinion of members of the commission, chairman of the Central Election Commission M. Panahov told: “Exclusive role belongs to the head of the state in conducting normal elections. The president of Azerbaijan, with the orders from May 11 and October 25, and also a lot of measures of the state value accepted by him has created necessary conditions for transparent, democratic elections to Milli Majlis according to the law. M. Panahov has expressed to the President of Azerbaijan Ilham Aliyev deep gratitude for all this. The Chairman has noted that a number of the state structures also rendered the Central Election Commission assistance in this cause. Then, he thanked representatives of mass media for coverage of elections and the state structures which have rendered assistance to election process.
Then, the question of the agenda has been put on voting. With 11 voices for and 4 against, the decision about representation to the Constitutional Court of the Azerbaijan Republic of reports of the district election commissions together with the documents enclosed to them for drawing up of the Central Election Commission of the Azerbaijan Republic of the report on the general results of elections, check and the statement of results of elections was accepted in connection with the elections carried out on November 6, 2005 to Milli Majlis.
At the session of the Central Election Commission also were present representatives of the OSCE Bureau of Democratic Institutes and Human Rights (ODIHR), embassy of the USA and the International Fund on electoral systems, local and foreign mass media.
