INSTITUTE OF ADVOCACY IMPROVING IN AZERBAIJAN
In conversation with correspondent of AzerTAj, chairman of Board of the Bar Azer Tagiyev has told concerning changes and amendments made in the Law: “Now in our country, there are about 400 lawyers engaged in advocatory activity. Considering importance of strengthening of their activity and protection of human rights in our country, the Law “On advocates and advocacy” was amended. In the changes and supplements, it is stated that the person wishing to be engaged in advocacy, should have juridical education, and minimum three years of working experience on the specialty of the jurist or within three years to work in scientific and pedagogical educational institutions in the field of law.. After that, in the Commission on specialty they should pass the written test and oral interview with the purpose of definition of their professional suitability. Only after successful passing the examination on specialty, these persons can work as lawyers in courts of the first instance.
The commission on specialty as a whole is created in staff of 11 people where enters five lawyers, three judges and three scientists - jurists. However, it is necessary to take into account, that the Law has no return force, and the lawyers and the judges earlier successfully passed corresponding examination on specialty, passing only oral interview can work as a lawyer. Without passage of the test and oral interview by lawyers, there can be the persons having a scientific degree of the doctor of jurisprudence, the judge of the Constitutional Court of the Azerbaijan Republic, the jurists working in the post of chairmen of courts of appeal and cassation instances. Here, there is one interesting moment. The persons who have started lawyer activity after adoption of the Law, in the beginning should carry out at least three years lawyer activity in courts of the lower instance. Then, after delivery of repeated examination, they can work in appeal courts, and after a certain term of work here they again pass examination and can have opportunity to work as lawyers in the Constitutional and Supreme Courts.
I think, that the present Law will serve greater development and improvement of Institute of advocacy in the Republic”.
