Azerbaijan’s Constitutional Court confirms compliance of parliament’s dissolution with Constitution

Azerbaijan`s Constitutional Court has held a plenary session to review the President`s request regarding compliance of the dissolution of the parliament with the country`s Constitution. On Monday, Azerbaijan's top legislative body, the Milli Majlis, adopted an appeal to the President on dissolving the parliament and holding early elections.
Opening the session, chairman of the Constitutional Court Farhad Abdullayev announced its composition and highlighted the issue to be considered.
Head of the Department of Legislation and Legal Policy of the Presidential Administration Gunduz Karimov attended the session as a representative of the requesting party, while chairman of the MIlli Majlis legal policy and state building committee Ali Huseynli, Milli Majlis Chief of Staff Safa Mirzayev and Associate Professor of Constitutional Law of the Faculty of Law of Baku State University, Ph.D. in Law Nasib Shukurov represented the responding party.
Following the speeches, members of the plenary session of the Constitutional Court retired to make a final decision on the issues on the agenda.

Chairman of the Constitutional Court Farhad Abdullayev then read out the decision of the plenary session of the Constitutional Court of the Republic of Azerbaijan.
"Resolution of the Milli Majlis of the Republic of Azerbaijan of December 2, 2019, "Appealing to the President of the Republic of Azerbaijan to call early elections to the Milli Majlis of the Republic of Azerbaijan” shall be considered to be in compliance with section 1 of Article 981 of the Constitution of the Republic of Azerbaijan."
The dissolution, by the President of the Republic of Azerbaijan, of the Milli Majlis of the Republic of Azerbaijan based on Resolution of the Milli Majlis of the Republic of Azerbaijan of December 2, 2019, "Appealing to the President of the Republic of Azerbaijan to call early elections to the Milli Majlis of the Republic of Azerbaijan” shall be considered to be in compliance with section 1 of Article 981 of the Constitution of the Republic of Azerbaijan."
Under the Resolution, until the beginning of the activity of the next convocation of the Milli Majlis of the Republic of Azerbaijan, the parliament - in its current composition - shall retain powers vested in it in accordance with Articles 111 and 112 and paragraphs 16 and 17 of section I of Article 95 of the Constitution of the Republic of Azerbaijan, as well as fulfill its representative functions in international organizations.
The Resolution becomes effective on the date of its announcement, it is irreversible and cannot be annulled, amended or officially interpreted by any entity or individual. The plenary session of the Constitution Court was then announced closed.
