Taking into account, that the stat privatization checks of the Azerbaijan Republic are not completely used in privatization of the state property, with a view of the further expansion of participation of the population, including local and foreign businessmen during privatization, attraction of investments into the national economy, and also improvement of social welfare of the population, I, hereby, resolve:

1. To establish, that:

1.1. Term of use of state privatization checks as payment means at privatization of the state property is till January 1, 2008;

1.2. Privatization checks which have not been used as payment means at privatization of the state property up to term, specified in the paragraph 1.1 of the present Decree, in the order established by the legislation are excluded from the circulation.

2. To establish, that:

2.1. To the citizens of the Azerbaijan Republic who according to the legislation on privatization of the state property of the Azerbaijan Republic have been assigned the right of reception in due time of state privatization checks, but for whatever reasons could not receive it, for reception of the mentioned checks 3 months are given from the date of the introduction of the present Decree into force;

2.2. Within 2 months after end of the term established in sub-paragraph 2.1 of the present Decree, to the below-mentioned citizens of the Azerbaijan Republic assigned the right of reception of the state privatization check, once again is given out state privatization check consisting of 4 (four) checks:

2.2.1. To heir-at-laws of the citizens becoming sheihds in fight for territorial integrity, sovereignty and state independence of the Azerbaijan Republic, and sheihds on 20 January;

2.2.2. To the citizens of the Azerbaijan Republic who have received wounds during military operations for clearing of the lands of the Azerbaijan Republic, its territorial integrity and independence and taking part in the given operations (corresponding lists are represented by the Ministries of Defense, internal affairs and national safety);

2.2.3. To the national Heroes of the Azerbaijan Republic, Heroes of Soviet Union, Heroes of Socialist Labor and the persons equal to them;

2.2.4. To the citizens of the Azerbaijan Republic, who became invalids during events on 20 January, invalids of the Second World War, to families of the citizens who have lost in the Afghan war, and invalids of the said war, citizens of the Azerbaijan Republic, who became invalids during liquidation of consequences of Chernobyl catastrophe;

2.3. To the persons who were taking part in the Second World War, it is given out additional state privatization check, consisting of 4 (four) checks (corresponding lists are represented by the Ministries of Defense, internal affairs and national safety).

3. To amend the following Decrees of the President of the Azerbaijan Republic:

3.1. In the Decree of the President of the Azerbaijan Republic #383 from August 10, 2000 “On approval of the “II State Program of privatization of the state property in the Azerbaijan Republic” (the Collection of Acts of the Azerbaijan Republic, 2000, # 8, the book III, Article 606) to make the following amendments:

3.1.1. Paragraph 2 of the Decree to count invalid;

3.1.2. Paragraph 1.5 and the second paragraph of 10.4 authorized by the said Decree on “II State Program of privatization of the state property in the Azerbaijan Republic”, the words “till July, 1, 2004 ” to replace with words “till January 1, 2008 ”.

3.2. The third and fourth paragraphs of point 43 of the unit of II Decree of the President of the Azerbaijan Republic # 587 from October 11, 2001 “On recognition of some decrees and orders of the President of the Azerbaijan Republic as invalid and modifying in some decrees and orders in connection with the statement of Regulations about the ministry of economic development of the Azerbaijan Republic” (Collection of Acts of the Azerbaijan Republic, 2001, # 10, Aricle 640) to consider invalid.

4. To assign the Cabinet of the Azerbaijan Republic:

4.1. Within a month to ratify rules of delivery in established by the point 2 of the present Decree terms to some layers of the population the state privatization checks and structure of the commission on the organization of delivery state privatization checks;

4.2. In case after delivery according to the point 2 of the present Decree to some categories of citizens of the country of new checks, state privatization checks will be considered not given, - to establish rules of their cancellation and to take measures necessary for it;

4.3. To solve other questions stemming from the present Decree.

5. To assign the ministry of economic development of the Azerbaijan Republic:

5.1. Within 15 days to prepare and coordinate with the concerned bodies the project of the corresponding rules connected to delivery in established in the point 2 of the present Decree terms to some layers of the population state privatization checks and submit it to Cabinet of the Azerbaijan Republic;

5.2. To take necessary measures for effective use of state privatization checks during privatization.

6. To the ministry of economic development of the Azerbaijan Republic and the State Committee on securities under the President of the Azerbaijan Republic to take necessary measures on improvement of work of the organized market of privatization checks.

7. The present Decree inures from the date of publication.
