INTERNATIONAL LAW ALLOWS EXTRADITION OF PERSONS PUNISHED WITH TERRORIST CONNECTION
Security and defense standing committee of the Milli Majlis of Azerbaijan Republic on 15 February discussed the bill “On approval of the additional protocol to the European Convention “On prevention of terrorism”.
First Vice-Speaker of Azerbaijan Parliament, head of the Committee Ziyafet Askarov said the Bill was initiated by the President of country. The Additional Protocol to Convention adopted in 1977 envisages removing extradition of the persons and crimes with political motives from the crimes of terrorism. As stated, Azerbaijan accedes to this Protocol and asserts that it is not responsible for implementation of the mentioned clauses of the Protocol at the territories occupied by Armenia.
Chief of the Milli Majlis Administration’s military legislature sector Nizami Safarov stated that according to Protocol, after extradition the person punished for terrorist offences cannot be sentenced to capital punishment and on the contrary, the extraditing side cannot alleviate his punishment. Currently, 27 Council of Europe member countries have ratified the Protocol.
The parliamentarians noted importance of the document, stressing that it is adequate to national interests of Azerbaijan.
The Bill was recommended for discussions at the Milli Majlis.
